මාධ්‍ය මර්ධනයට එරෙහිවත්, අවනීතියට එරෙහිවත් ‛කළු ජනවාරි’ විරෝධය ඊයේ(29) ලිප්ටන් වටරවුමේදී විශාල පිරිසකගේ සහභාගීත්වයෙන් පැවැත් වීය. දේශපාලන පක්ෂ නායකයින්, වෘත්තීය සමිති, ශිෂ්‍ය ව්‍යාපාර, නීතිඥ සංවිධාන මෙන්ම බහුජන සංවිධානවල සමාජිකයින් සහභාගී වූ මෙම විරෝධය ජනමාධ්‍ය සංවිධාන සංවිධාන කරනු ලැබූවේ, විශේෂයෙන් පසුගිය කාලය තුළ ශ්‍රී ලංකාවේ ජනමාධ්‍යට එරෙහිව එල්ල වූ මර්දනයට එරෙහිවත් විශේෂයෙන්ම ඝාතනයන්ට, ප්‍රහාරයන්ට හා අතුරුදහන් කිරීම් වලට ලක් වූ මාධ්‍යවේදීන් හා මාධ්‍ය සේවකයින්ට අදාළව නීතිය ක්‍රියාත්මක කර වගකිව යුත්තන්ට දඬුවම් ලබා දීමට ආණ්ඩුව ක්‍රියා නොකිරීම පිළිබදව විරෝධය පළ කිරීම සඳහා ය. එහිදී පසුගිය කාලය තුළදී ජනවාරි මාසය තුළ සිදු කළ ලසන්ත වික්‍රමතුංග ඝාතනය, සිරස මාධ්‍ය ආයතනයට එල්ල වූ ප්‍රහාරය මෙන්ම මාධ්‍යවේදී ප්‍රගීත් එක්ණැලිගොඩ අතුරුදහන් කිරීම වැනි බරපතල සිදුවීම් ද, ඝාතනය කළ මාධ්‍යවේදී සිවරාම්, නිමලරාජන්, සුගීධරන් මෙන්ම බරපතල ප්‍රහාරයන් ලක්වූ පෝද්දල, කූගනාදන් වැනි මාධ්‍යවේදීන්ට ද තවමත් යුක්තිය ඉෂඨ නොවීම සලකා අදාල විරෝධතාවය ‛කළු ජනවාරිය’ ලෙස නම් කිරීමට තීරණය කරනු ලැබූ බව විරෝධතාවය සංවිධානය කළ  මාධ්‍ය සංවිධාන එකතුව ප්‍රකාශ කළේ ය.කෙසේ නමුත් පසුගිය කාලය පුරාම විශේෂයෙන් ජනවාරි මස තුළදී පමණක් ජනමාධ්‍යට එල්ලකල ප්‍රහාරයන් අති විශාලය. එමෙන්ම බිහිසුනුය.  නමුත් ඒ කිසිදු සිදුවීමකට වගකිව යුත්තන් නීතිය ඉදිරියට පැමිණ වීමට පිළිගත හැකි පරීක්ෂණයක්වත් සිදු කිරීමට රාජපක්ෂ ආණ්ඩුව මෙන්ම ඊට පෙර පැවති කිසිදු ආණ්ඩුවක් සමත් වී නැත. එබැවින් කළු ජූලිය මෙන් කළු ජනවාරියද ලංකාවේ ප්‍රජාතන්ත්‍රවදාය මෙන්ම මානව හිමිකම්වල තරම මැනවින් කියාපාන මාසයන්ය. ලංකාවේ ආණ්ඩුකරණය පිළිබදව මෙන්ම ලංකාවේ ජනමාධ්‍ය නිදහසේ තරම මැනවින් කියාපාන මාසයන් ය. එබැවින් පාලකයන්ගේ ආශීර්වාදය මැද, පොලීසිය බලා සිටිය දී ම්ලේච්ඡ ලෙස මිනිසුන් මරා දැමූ ‛කළු ජූලිය’ මෙන් ‛කළු ජනවාරිය ද කළුම කළුය.

Lawyers Urge the Government of Sri Lanka to Respect the Right to Peaceful Assembly

The Lawyers for Democracy (LfD) condemns the tactics used by the Government and its agents to disregard the fundamental right of a citizen to conduct peaceful protests in Sri Lanka, and the use of deplorable strong armed tactics to prevent a lawful protest rally organized by media groups today (25^th January 2012) titled ‘Black January’to be originally held at the Fort Railway station, Colombo.

The protest rally was organized by several media groups to highlight the challenging conditions faced by media actors in Sri Lanka and to mark the death and disappearances of several colleagues who were either killed or disappeared in the month of January. In light of such a protest rally, several measures were taken by the Government and its agents to thwart the right to dissent. LfD was informed that the police had attempted to obtain a court order to prevent the lawful demonstration.  Media reported that government backed protestors were transported at the instance of government to the vicinity of the Fort Railway station,  close to the time when the media demonstration was to commence. In light of the security threats, the media groups had to change the location of the protest rally with short notice.

LfD reiterate that the Constitution of Sri Lanka guarantees the freedom of peaceful assembly. All public organs of the state including the police and judiciary are expected to respect, secure and advance the fundamental rights guaranteed to its citizens.  LfD is seriously concerned about the recent development where the police is seeking ex parte judicial orders to curtail peaceful meetings, all of which are clear political expressions against the government. We are also unable to apprehend the legal provisions that authorise the police to obtain judicial orders in these instances.  The Supreme Court has time and again recognizedthat the “right to support or criticize the government is fundamental to the democratic way of life, which cannot be denied without violating those fundamental principles of liberty and justice, which lies at the base of all civil and political institutions”. We are also seriously concerned with the tactics used including the use of government back armed actors to disturb peaceful rallies and demonstrations. The impunity with which these groups operate is alarming. For example, today’s events were witnessed by the police who stood by and did nothing to prevent the goons from arriving to disrupt a planned protest rally. Such incidents are indicators of the breakdown of law and order and the threat to the democratic culture in Sri Lanka. We urge the Government of Sri Lanka to respect its constitutional obligations andcommitment to respect freedom of expression and peaceful assembly and prevent the repeat of such events in the future.

‘Lawyers of Democracy (LfD) is a representative body of legal practitioners throughout the island. Conveners include Lal Wijenayaka, Chandrapala Kumarage, K.S. Ratnavale, J.C. Weliamuna and Sudarshana Gunawardana. It was established on 10^th December 2010.

“BLACK JANUARY” Protest Against Media Suppression | Open Media Confernce

කළු ජනවාරිය විරෝධතාවට අධිකරණයෙන් සීමා – ‘නමුත් අපි විරෝධතාවය පවත්වනවා‘ -මාධ්‍ය සංවිධාන

මාධ්‍ය සංවිධාන එකමුතුව විසින් අද සවස කොළඹ කොටුවේදී සංවිධානය කර ඇති “කළු ජනවාරිය” විරෝධතා ව්‍යාපාරය ප්‍රධාන මාර්ගය අවහිර වන ආකාරයෙන් පැවැත්වීම තහනම් කරමින් කොටුව මහේස්ත්‍රාත් අධිකරණය විසින් නියෝග කර තිබේ. නමුත් මෙම නියෝගය නිකුත් කළත් විරෝධතාවය පවත්වන බවත්, මාධ්‍ය සංවිධාන විසින් මෙතෙක් පවත්වන ලද කිසිදු විරෝධතාවයක් ගැටුමක් දක්වා වර්ධනය කර නොගත් බවත් අද ද එය එසේම බවත් නිදහස් මාධ්‍ය ව්‍යාපාරය පෙන්වා දෙයි. එබැවින් සැළසුම් කර ගත් පරිදි මෙම විරෝධය අද සවස 2ට කොටුව දුම්රියපොළ ඉදිරිපිටදී පවත්වන බව මාධය සංවිධාන පවසයි.

නමුත් අධිකරණය මෙම නියෝගය නිකුත් කළේ කොටුව පොලීසිය විසින් ඊයේ ‍ඉදිරිපත් කරන ලද පැමිණිලක් සලකා බැලීමෙන් අනතුරුවය.

මෙම විරෝධතා ව්‍යාපාරය කඩා කප්පල් කිරීම සඳහා ආණ්ඩුව මුල සිටම උත්සාහ දැරූ අතර විරෝධතාව අතරතුරදී ආරක්ෂක අංශ සමඟ ගැටුමක් ඇති කර ගැනීමේ ප්‍රයත්නයක් තිබෙන බවටද ආණ්ඩුවේ මාධ්‍ය හරහා විශාල ප්‍රචාරයක් ගෙන යන ලදී.

ලංකාවේ මාධ්‍ය මර්දනයට එරෙහිව සංවිධානය කර ඇති මෙම ‘කලු ජනවාරිය‘ විරෝධතාව මර්දනය කිරීමට බළධාරීන් ගන්නා උත්සාහය තුළින්ම ආන්ඩුවේ මාධ්‍ය මර්දනයේ තරම වටහා ගත හැකි බව ද මාද්‍ය සංවිධාන වැඩිදුරටත් පෙන්වා දෙයි.

In Sri Lanka, Eknelygoda asks that humanity trump cruelty

A couple of weeks ago, I described the terrible incidence of anti-press abuse that has come each recent January in Sri Lanka. Media activists have come to call the month “Black January” for good reason, as this email message details:

The Alliance of Media Organizations, spearheaded by the Free Media Movement, has earmarked January 25, as Black January Day on account of the numerous attacks against the media unleashed by the government in the past three years, especially in the month of January. These include the murder of Sunday Leader editor [Lasantha Wickramatunga], the fire bomb attack on Sirasa/MTV studios and the attack on Rivira editor Upali Tennakoon in 2009, [see CPJ's Special Report: Failure to Investigate], the disappearance of Prageeth Eknelygoda, the sealing of Lanka newspapers and the detention of its editor in 2010, and the arson attack on Lanka eNews office in 2011.

January 24 marks the second anniversary of the disappearance of Prageeth Eknelygoda, a cartoonist and columnist for the pro-opposition Lanka eNews website. The case is among several anti-press attacks that are tied up in court hearings without substantive law enforcement action. Eknelygoda’s wife, Sandhya, and two sons have gotten no word from any official body of the Sri Lankan government, from the lowest police desk to the highest levels of the ministry of justice, about what happened to the journalist.

On Tuesday, as she did last year, Sandhya Eknelygoda will take another step in pressing the government to conduct an investigation into her husband’s disappearance. Here is the plan, according to an email message sent over the weekend:

Women have taken the initiative to commemorate the second year of the disappearance of Prageeth Eknaligoda and of all the other disappeared persons on the 24th January 2012, in front of the Fort Railway Station at 4.30 p.m.

They will sit down in deep silence to make their protest to the murderers and the destroyers of these valuable lives, with the firm determination to eradicate this inhuman and barbarous culture of revenge and criminality against humanity.

The most interesting feature would be the procession of women moving to the church in New Chetty Street, Kochcikade to invoke the blessings of Virgin Mary, Prajapathi Gothami, Goddess Paththini, and Goddess Kali.

All sympathy and support is welcome to share in this symbolic gesture of this heroic effort of these women who are suffering daily with the awful and unbearable loss of their loved ones.

On January 25, 2011, Sandhya Eknelygoda submitted a petition calling on U.N. Secretary-General Ban Ki-moon and other U.N. officials to encourage the Sri Lankan government to investigate the disappearance of her husband. The request to the U.N. has been unmet.

In March 2011, CPJ and four other groups sent a letter to Ban asking him to direct the U.N. High Commissioner for Human Rights and UNESCO, which oversees press freedom, to look into the case of Eknelygoda. There has been no meaningful response from the United Nations. Sandhya Eknelygoda’s personal appeal to the president’s wife, Shiranthi Rajapaksa, has also gone unanswered.

Consider this vast indifference. What can this soft-spoken mother of two teenage boys possibly do? Yet her words this year invoke a faith in humanity that transcends the cruelty she has experienced, as she calls on like-minded women to “sit down in deep silence … with the firm determination to eradicate this inhuman and barbarous culture of revenge and criminality.”
